What Qualifies as Aggravated Assault?
It is important to note that assault can be an act of violence or a threat of violence and in the state of Texas, battery is still termed as assault. Due to the violent crime nature of these charges, the court system takes them seriously. In some circumstances, these can be charged as felonies.
We can help with a variety of assault charges including:
- Simple assault: If a victim sustains only minor injuries after physical violence, you can be charged with simple assault. Without enhanced charges, a conviction can still lead to up to a year in prison and a fine of up to $4,000.
- Aggravated assault: If the accused aggressor was bearing or had in their possession a firearm during the time of the assault, the charges are enhanced. They do not have to use the firearm during the assault at all, merely having it in their possession is enough. Aggravated assault convictions can be punished with life sentences.
